Amaryn Pulse Terms of Service

1. Who we are and what these terms cover

These terms apply to the Amaryn Pulse iOS app, the Amaryn Pulse server plugin and the related online service (together: "Amaryn Pulse"). By creating an account or using Amaryn Pulse, you agree to these terms.

Amaryn Pulse is provided by Jelle Meinesz, trading as Amaryn, registered with the Dutch Chamber of Commerce (KvK) under number 42138186, Box C0984, Oder 20, 2491 DC Den Haag, the Netherlands. Contact: [email protected].

2. Your account

You sign in with Apple. You are responsible for what happens under your account and for keeping your device secure.

You must be at least 16 years old to use Amaryn Pulse. If you are younger, you may only use it with permission from a parent or guardian.

You can delete your account at any time in the app, under Settings, Delete account. Deleting your account does not cancel an Apple subscription; cancel that separately in your Apple Account settings.

3. Free tier, subscriptions and payment

Amaryn Pulse has a free tier and paid subscriptions (Pro and Network). What each tier includes is shown in the app before you buy.

Payment through Apple. All purchases are made through the App Store. Apple charges you, and Apple's terms apply to the payment. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period. You can manage or cancel your subscription in your Apple Account settings. Refund requests are handled by Apple. This does not affect any rights you have under consumer law.

Price changes. We may change subscription prices. Apple will tell you in advance, and you can cancel before a new price applies.

4. What Amaryn Pulse does and does not promise

Amaryn Pulse is a helpful tool, not a replacement for your own server monitoring. We do our best to keep the service running and your data accurate, but we provide it on a best-effort basis.

• No guaranteed availability. We do not offer a service level agreement. The service may be unavailable at times, for example during maintenance or outages.
• Alerts can be late or fail to arrive. Push notifications depend on third parties, including Apple Push Notification service, your network connection and the settings on your device. We cannot guarantee that an alert arrives, or arrives on time.
• Data may be incomplete. Metrics depend on your server, the plugin and network connections. Gaps or inaccuracies can occur.

Do not rely on Amaryn Pulse as your only way of finding out that something is wrong with your server.

5. The server plugin

The Amaryn Pulse plugin is open source and available under the Apache 2.0 licence. That licence governs your use of the plugin's code. These terms govern your use of the online service the plugin connects to.

The plugin is built to run in the background without affecting your server's performance. Still, you are responsible for your own server. That includes which plugins you install, keeping backups and testing updates before using them in production.

Only install the plugin on servers you own or are allowed to manage. If other people play on your server, it is your responsibility to inform them where required. The plugin does not store player names or UUIDs; see the Privacy Policy.

6. Fair use

You may not:

• Add servers you have no right to monitor in order to harm or overload them
• Attempt to access other users' data or our systems without permission
• Send fake, manipulated or excessive data to our service, or try to get around rate limits or tier limits
• Reverse engineer the app or service, except where the law allows it or the plugin's open-source licence permits it
• Use Amaryn Pulse for anything illegal

If you break these rules, we may suspend or close your account or revoke plugin tokens. Where reasonable, we warn you first. If we close a paid account without good reason, you keep your rights under consumer law.

7. Liability

Our total liability to you is limited to the amount you paid us for Amaryn Pulse in the 12 months before the event that caused the damage. If you use only the free tier, that amount is zero.

We are not liable for indirect damage, such as lost income, lost players, lost data or damage caused by an alert that arrived late or not at all.

These limits do not apply where the damage was caused by our intent or gross negligence, or where the law does not allow liability to be limited. Nothing in these terms takes away rights you have as a consumer under mandatory law.

8. Changes, ending the service and governing law

Changes to Amaryn Pulse. We may add, change or remove features. If a change significantly reduces what a paid tier includes, we tell you in advance in the app, and you can cancel your subscription.

Changes to these terms. We announce significant changes in the app at least 30 days before they take effect. If you keep using Amaryn Pulse after that, the new terms apply. If you do not agree, you can stop using the service and delete your account.

Ending the service. We may stop offering Amaryn Pulse. If we do, we give at least 60 days' notice in the app, stop selling new subscriptions, and let existing subscriptions run out.

Transfer. We may transfer Amaryn Pulse, including these terms, to another party. Your rights under these terms transfer with it.

Governing law. Dutch law applies to these terms. If you are a consumer living elsewhere in the EU, you keep the protection of the mandatory rules of your own country. Disputes go to the competent court in the Netherlands, unless the law gives you the right to go to a court where you live.
